About the right team member

This is a unique opportunity for an experienced Product & Privacy Counsel to join our Legal team and support Mindbody + ClassPass around the world. You will play a critical role in embedding legal compliance into Mindbody’s product lifecycle while ensuring the business retains its bias towards action and continues to move quickly while innovating responsibly. You will advise on Mindbody’s suite of B2B and B2C products, with a focus on privacy, data protection, consumer protection, marketing laws and requirements and other regulatory matters related to our products and services. Working in a highly motivated, dynamic environment, you’ll be ready to roll up your sleeves and engage collaboratively with external and internal stakeholders - including outside counsel, employees and executives worldwide - to juggle deadlines, manage simultaneous projects on a variety of legal matters and jump in wherever needed to get the job done. 

About the role

As Privacy & Product Counsel you will: 

  • Be the lead Legal contact for Mindbody’s Product, Design and Engineering, Security and Marketing teams, attending monthly squad reviews, building relationships of trust and providing timely, pragmatic advice on the legal implications of new product design and development; 
  • Monitor, research and analyze regulatory developments worldwide which affect Mindbody and its customers to ensure proactive compliance with key federal, state and global regulations, including the CCPA/GDPR and US state privacy laws, TCPA, the ePrivacy Directive, HIPAA and laws relating to autorenewal subscriptions and AI; 
  • Assist with Mindbody’s privacy program, including maintenance of records of data processing activities, conducting data protection impact and legitimate interest assessments, and ensuring privacy-by-design is factored in to product development; 
  • Partner with Mindbody’s Security team to continue to improve Mindbody’s privacy, safety and security-by-design requirements and handling privacy inquiries; 
  • Draft, maintain and update internal policies and contractual documentation with customers, consumers and suppliers, including terms of use, privacy policies and data protection agreements; 
  • Collaborate with sales, marketing and operations teams to support commercial negotiations and ensure our advertising and marketing campaigns are aligned with marketing laws worldwide; 
  • Partner with all other practice areas within the Legal team as the subject matter expert in your area, including assisting the commercial legal team in drafting, reviewing, and negotiating legal agreements, assisting with M&A, employment and dispute resolution activities and, when appropriate, taking the lead on contracts and other projects; 
  • Prepare and deliver privacy and product compliance training when needed; 
  • Be prepared to work within US time zones. 

 

Skills & experience

  • Bachelors degree (or foreign equivalent) and qualified to practice law. 
  • 5-10 years’ relevant legal experience. In-house experience a plus, ideally in the technology industry. 
  • Strong experience advising on consumer protection and privacy requirements in the US, UK and Europe essential. 
  • Self-Motivated. You have hustle, an ability to drive cross-functional projects and deep experience advising clients and managing projects on deadlines with minimal supervision. 
  • A team player. You're willing to help wherever needed, adept at working smart and able to juggle many competing priorities. 
  • Excellent communication skills, including the ability to finely tune your communications based on the audience. 
  • Exceptional interpersonal skills, sense of humor, highly team-oriented and a commitment to high legal standards and professionalism required.  
  • Excellent analytical skills with strong attention to detail, with demonstrated ability to analyze legal advice and apply it to business needs in a dynamic, sometimes ambiguous environment.

It is Mindbody’s intent to pay all Team Members competitive wages and salaries that are motivational, fair and equitable. The goal of Mindbody’s compensation program is to be transparent, attract potential employees, meet the needs of all current employees, and encourage Team Members to stay with our organization.

Actual compensation packages are based on several factors that are unique to each candidate, including but not limited to skill set, depth of experience, certifications, and specific work location.

The base salary range for this position in the United States is $161,300 - $201,700. The total compensation package for this position may also include performance bonus, stock, benefits and/or other applicable incentive compensation plans.
